A Chapter 7 Bankruptcy, also called “liquidation” or "straight” bankruptcy, is a form of a personal bankruptcy where the goal is for the debtor to obtain a “fresh financial start” through the discharge of many, if not all, of their outstanding debts.

In a Chapter 7 Bankruptcy, a trustee will be appointed by the court to liquidate (sell) a debtor’s assets, which do not fall under the bankruptcy exemption guidelines, and distribute the net proceeds of the sale of non-exempt assets to your creditors. However, in many cases, most, if not all of a debtor’s assets are protected by state or federal exemptions, and may not be subject to the liquidation process. In other words, many debtors will not lose any of their personal possessions due to filing for bankruptcy.

While many types of debts can be discharged through bankruptcy, there are many types of detbs that cannot be discharged in a Chapter 7 bankruptcy which may include, but not limited to:

  • Alimony spousal support;

  • Child support;

  • Fraudulent debts;

  • Certain taxes;

  • Student loans;

  • And certain items which have been charged.

After you have filed for bankruptcy, creditors and collection agencies can no longer attempt to contact you. If they do, they may face potential fines and/or penalties themselves.
